Abstract
Justice Sandra Day O'Connors ruled that "The government's use of its own land should not and need not discourage it from accommodating religious practices like those engaged by Indians."
Justice Brennan, on the other hand dissented, "this ruling essential leaves Native Americans with no constitutional protection against perhaps the gravest of all threat to their religious practices."
Justice Brennan also said, "I find it difficult to imagine conduct more insensitive to religious needs then the government's determination to build a marginally useful road in the face of uncontradicted evidence that the road will render the practice of the Indians' religion impossible."
