Abstract

Even assuming that the Government's actions here will virtually destroy the Indians' ability to practice their religion, the Constitution simply does not provide a principle that could justify upholding respondent's legal claims. This gives the U.S. government the legal right to commit acts and develop policies, on public land, which result in the destruction of any religious group. If the government wishes to do something, their plans can automatically override religious freedom rights.
