The government's opening argument in the lower courts predicates that local Native Americans have over 25 sacred sites in the Six River National Forest according to the Environmental Impact Statement therefore, the Forest Service should be allowed to complete the construction of the six miles of road that would open the Blue Creek area up to timber harvesting. Judge Stanley Weigel said that spiritual sites in the Six Rivers National Forest is on an individual basis.
